Allgemeine Geschäftsbedingungen für Pawtner

Diese Allgemeinen Geschäftsbedingungen ("AGB") regeln Ihren Zugriff auf und Ihre Nutzung der mobilen Anwendung Pawtner (die "App"), die von der fecra GmbH ("wir", "uns" oder "unser") bereitgestellt wird. Durch die Erstellung eines Kontos oder die Nutzung der App erklären Sie sich mit diesen AGB einverstanden.
1. Umfang der Lizenz
Wir gewähren Ihnen eine beschränkte, nicht-exklusive, nicht übertragbare und widerrufliche Lizenz zur Nutzung der App für Ihre persönlichen, nicht-kommerziellen Zwecke auf jedem Gerät, das Sie besitzen oder kontrollieren, gemäß diesen AGB.
2. Benutzerkonten und Verantwortlichkeiten
a. Kontoerstellung: Sie müssen genaue und vollständige Informationen angeben, um ein Konto zu erstellen. Sie sind für die Geheimhaltung Ihres Kontopassworts und für alle Aktivitäten, die unter Ihrem Konto stattfinden, verantwortlich.
b. Nutzerverhalten: Sie stimmen zu, die App nicht zu verwenden, um:
- Inhalte zu posten oder zu übertragen, die rechtswidrig, schädlich, verleumderisch, obszön, verletzend, belästigend oder rassistisch oder ethnisch beleidigend sind.
- die Privatsphäre oder die geistigen Eigentumsrechte anderer zu verletzen.
- unerwünschte oder nicht autorisierte Werbung, Werbematerialien oder Spam zu versenden.
- sich als eine andere Person oder Einrichtung auszugeben oder Ihre Zugehörigkeit zu einer Person oder Einrichtung fälschlicherweise anzugeben oder anderweitig falsch darzustellen.
c. Nutzerinhalte: Sie sind allein verantwortlich für alle Inhalte, einschließlich Fotos, Texte, Informationen über Ihre Tiere und andere Materialien, die Sie über die App posten, hochladen oder teilen ("Nutzerinhalte"). Sie behalten alle Eigentumsrechte an Ihren Nutzerinhalten. Durch das Einreichen von Nutzerinhalten in der App gewähren Sie uns jedoch eine weltweite, nicht-exklusive, gebührenfreie Lizenz zur Nutzung, zum Kopieren, Reproduzieren, Verarbeiten, Anpassen, Modifizieren, Veröffentlichen, Übertragen, Anzeigen und Verteilen solcher Nutzerinhalte im Zusammenhang mit dem Betrieb und der Bereitstellung der App.
d. Inhaltsmoderation: Wir behalten uns das Recht vor, sind aber nicht dazu verpflichtet, Nutzerinhalte zu überprüfen, zu sichten und zu entfernen, die gegen diese AGB verstoßen oder anderweitig anstößig sind, nach unserem alleinigen Ermessen und ohne vorherige Ankündigung.
3. Dienste
Die App wird auf einer "wie besehen" und "wie verfügbar" Basis bereitgestellt. Wir können ohne vorherige Ankündigung die App ändern, die Bereitstellung der App oder von Funktionen der App für Sie oder für Nutzer im Allgemeinen einstellen oder Nutzungsgrenzen für die App festlegen.
4. Geistiges Eigentum
Alle Rechte, Titel und Interessen an der App (ausgenommen Nutzerinhalte) sind und bleiben das ausschließliche Eigentum der fecra GmbH und ihrer Lizenzgeber. Die App ist durch Urheber-, Marken- und andere Gesetze sowohl in Deutschland als auch im Ausland geschützt. Nichts in den AGB gibt Ihnen das Recht, den Namen Pawtner oder irgendwelche der Pawtner-Marken, Logos, Domainnamen und andere charakteristische Markenkennzeichen zu verwenden.
5. Kündigung
a. Durch Sie: Sie können diesen Vertrag jederzeit kündigen, indem Sie Ihr Konto löschen und die Nutzung der App einstellen.
b. Durch uns: Wir können Ihr Konto und Ihren Zugang zur App jederzeit und aus beliebigem Grund sperren oder kündigen, einschließlich wenn wir glauben, dass Sie gegen diese AGB verstoßen haben. Mit der Kündigung erlischt Ihr Recht zur Nutzung der App sofort.
6. Gewährleistungsausschluss
IHRE NUTZUNG DER APP ERFOLGT AUF IHR EIGENES RISIKO. DIE APP WIRD "WIE BESEHEN" UND "WIE VERFÜGBAR" OHNE JEGLICHE AUSDRÜCKLICHE ODER STILLSCHWEIGENDE GEWÄHRLEISTUNG BEREITGESTELLT, EINSCHLIESSLICH, ABER NICHT BESCHRÄNKT AUF, STILLSCHWEIGENDE GEWÄHRLEISTUNGEN DER MARKTGÄNGIGKEIT, DER EIGNUNG FÜR EINEN BESTIMMTEN ZWECK UND DER NICHTVERLETZUNG VON RECHTEN DRITTER.
7. Haftungsbeschränkung
SOWEIT GESETZLICH ZULÄSSIG, HAFTEN DIE FECRA GMBH UND IHRE VERBUNDENEN UNTERNEHMEN, LEITENDEN ANGESTELLTEN, MITARBEITER UND VERTRETER NICHT FÜR INDIREKTE, ZUFÄLLIGE, BESONDERE, FOLGE- ODER STRAFSCHÄDEN ODER FÜR ENTGANGENE GEWINNE ODER EINNAHMEN, OB DIREKT ODER INDIREKT ENTSTANDEN, ODER FÜR DATENVERLUST, NUTZUNGSAUSFALL, GOODWILL-VERLUST ODER ANDERE IMMATERIELLE VERLUSTE, DIE SICH AUS IHREM ZUGRIFF AUF ODER IHRER NUTZUNG ODER DER UNFÄHIGKEIT ZUM ZUGRIFF AUF ODER ZUR NUTZUNG DER APP ERGEBEN.
8. Anwendbares Recht und Gerichtsstand
Diese AGB unterliegen den Gesetzen der Bundesrepublik Deutschland. Sie stimmen zu, dass alle rechtlichen Schritte oder Verfahren, die sich aus diesen AGB ergeben oder damit in Zusammenhang stehen, ausschließlich vor den zuständigen Gerichten in Berlin, Deutschland, geführt werden.
9. Änderungen der AGB
Wir behalten uns das Recht vor, diese AGB jederzeit zu ändern. Wir werden über solche Änderungen informieren, indem wir die überarbeiteten AGB in der App veröffentlichen. Ihre fortgesetzte Nutzung der App nach einer solchen Änderung stellt Ihre Zustimmung zu den neuen AGB dar.

These Terms and Conditions ("Terms") govern your access to and use of the Pawtner mobile application (the "App") provided by fecra GmbH ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.
1. Scope of License
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial purposes on any device that you own or control, subject to these Terms.
2. User Accounts and Responsibilities
a. Account Creation: You must provide accurate and complete information to create an account. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
b. User Conduct: You agree not to use the App to:
- Post or transmit any content that is unlawful, harmful, defamatory, obscene, infringing, harassing, or racially or ethnically offensive.
- Violate the privacy or intellectual property rights of others.
- Transmit any unsolicited or unauthorized advertising, promotional materials, or spam.
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
c. User Content: You are solely responsible for all content, including photos, text, information about your animals, and other materials that you post, upload, or share through the App ("User Content"). You retain all ownership rights to your User Content. However, by submitting User Content to the App, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in connection with operating and providing the App.
d. Content Moderation: We reserve the right, but are not obligated, to review, screen, and remove User Content that violates these Terms or is otherwise objectionable, at our sole discretion and without prior notice.
3. Services
The App is provided on an "as is" and "as available" basis. We may, without prior notice, change the App; stop providing the App or features of the App, to you or to users generally; or create usage limits for the App.
4. Intellectual Property
All rights, title, and interest in and to the App (excluding User Content) are and will remain the exclusive property of fecra GmbH and its licensors. The App is protected by copyright, trademark, and other laws of both Germany and foreign countries. Nothing in the Terms gives you a right to use the Pawtner name or any of the Pawtner trademarks, logos, domain names, and other distinctive brand features.
5. Termination
a. By You: You may terminate this agreement at any time by deleting your account and discontinuing your use of the App.
b. By Us: We may suspend or terminate your account and your access to the App at any time, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease.
6. Disclaimer of Warranties
YOUR USE OF THE APP IS AT YOUR SOLE RISK. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FECRA GMBH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.
8. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Federal Republic of Germany. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the competent courts of Berlin, Germany.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of such changes by posting the revised Terms on the App. Your continued use of the App after any such change constitutes your acceptance of the new Terms.
